Im assuming the 4k is in payment of some goods or service you provided (something like that). Not him just saying oh yeh ill give you 4k for nothing and then turning round and saying actually i want to keep my money.

after the original 52k was agreed on, the situation changed ( value of mortgage to be redeemed) and we sat down and agreed I would get 4k.

depends how the emails were worded I guess, if it is clear that he agreed to it, then get a cheap solicitor, if its a bit vague, get a better one. Definitely go the legal route. Then punch his face in when all is done and dusted.
